Is the judgment debtor allowed to file an insolvency claim before the Execution Judge?
No, the judgment debtor is not permitted to file an insolvency claim before the Execution Judge.
However, the debtor has the right to request the cancellation of the detention order before the Execution Judge or to appeal the detention order before the competent court, provided that the debtor has obtained a final insolvency judgment from the court of merits, or has proven insolvency by other means of evidence.
