The instances of interruption of the limitation period set forth in Article 16 of the Motor Vehicle Insurance Law are exhaustive. However, this article does not specify the grounds for suspension of the limitation period. Therefore, such cases are governed by the Civil Transactions Law, under which Article 346 recognizes a legitimate excuse as a valid ground for suspension.
The legal rationale lies in the distinction between suspension and interruption of the limitation period. As a result, a delay in filing a claim or contacting the insurance company due to awaiting final medical reports constitutes a legitimate excuse that suspends the limitation period until the issuance of that report.
