There is no prior registration of this trademark in the Sultanate by any party. The plaintiff’s claim of registering the mark in several foreign countries does not grant her the right to protection within the Sultanate.
This is unless both countries—the country of origin (Kuwait) and the country where the case is filed (the Sultanate of Oman)—are members of the Union, i.e., signatories to the Madrid Agreement of 1891 and its subsequent amending protocols. This legal framework governs the right of priority, which the plaintiff has neither claimed nor established.
Accordingly, invoking trademark registration in countries other than Oman has no legal effect and does not obligate the Sultanate to protect a trademark that has neither been registered nor used within its jurisdiction.
